The most interesting and important legal acts relate to an increase in customs duty rates, changes to the lists of standards for some technical regulations, additional charges when calculating the customs value of goods, etc.

In this review, we will consider the list of regulatory legal acts that come into force from January 1 to January 11, 2025.

January 1st:

* Federal Law No. 173-FZ of 04/28/2023: Russian organizations and sole proprietors receive the right to apply a zero VAT rate (0%) when selling goods to individuals abroad, if these goods were previously exported and shipped from a warehouse abroad. This is similar to the terms of trade with foreign companies.

* Decision of the Board of the EEC dated 29.10.2024 No. 119: Changes to the list of goods and import duty rates under the Free Trade Agreement between the EAEU and Vietnam.

* Decree of the Government of the Russian Federation dated 06.11.2024 No. 1486: The rules for confirming the export of goods, packaging and waste from the Russian Federation to be disposed of have been approved. Legal entities and sole proprietors submit information on customs declarations and statistical forms to a single information system. Valid until January 1, 2031.

* Decree of the Government of the Russian Federation dated 11/28/2024 No. 1637: The rates of customs duties for the release of goods have been increased:

* 1,067 rubles — for items worth up to 200,000 rubles.

* 2,134 rubles — for items priced from 200,001 to 450,000 rubles.

* 4,269 rubles — for items priced from 450,001 to 1,200,000 rubles.

* 30,000 rubles — for radio electronics.

New rates have also been set for water and aircraft.

* Temporary periodic declaration: The rate of customs duties is set at 10,672 rubles for each VAT. When submitting a full declaration — 30,000 rubles. The resolution also lowered the maximum threshold value of the total customs value of goods for which the maximum rate is applied (30,000 rubles) from 10 to 7 million rubles. The Decree of the Government of the Russian Federation dated 03/26/2020 No. 342 has become invalid.

* Exemption from duty on cattle meat: The decision of the EEC Council dated 11/29/2024 No. 107 amends the Decision of the CCC dated 11/27/2009 No. 130. Certain types of cattle meat for meat production in 2025 are exempt from import duties. Quotas are set for Armenia (9 thousand tons), Belarus (7.5 thousand tons), Kyrgyzstan (2.5 thousand tons) and Russia (100 thousand tons).

January 2:

* Mandatory conformity assessment of EAEU TR 052/2021: The list of products subject to mandatory assessment of compliance with the requirements of the EAEU Technical Regulations “On the Safety of Metro Rolling Stock” has been approved.

January 3rd:

* Updating the lists of standards for TR CU 008/2011 (“About toy safety”): The decision of the Board of the EEC dated 02.12.2024 No. 136 updates the lists of standards containing rules and methods of research and measurements for toys. New versions of the standards are included, and the old ones are limited in use.

* Additional charges in determining the customs value: The decision of the Board of the EEC dated 02.12.2024 No. 137 clarifies the calculation of additional charges to the customs value of imported goods when declaring several shipments.

* Accounting of royalties in the customs value: A unified approach is being established to account for royalties and other similar payments for the use of intellectual property objects in the customs value structure. When applying ad valorem and combined import duty rates, the declarant may, at will, add these payments to the price of the goods from the first batch, taxed at the highest rate. intellectual property.

January 5th:

* Extension of the anti-dumping duty on galvanized rolled products: The decision of the EEC Board dated 11/19/2024 No. 127 extends until September 1, 2025 the application of anti-dumping duties on galvanized rolled products from China and Ukraine (EAEU HS codes 7210 49 000 1, 7210 49 000 9, 7210 61 000 0, 7212 30 000 0, 7212 50 610 0 and 7225 92 000 0).

January 6th:

* Termination of FCS Order No. 228: FCS Order dated 29.10.

2024 No. 1084 cancels the order on destruction of goods placed under the customs procedure of the STZ and packaging.

January 8th:

* Changes in the lists of standards for the TR CU “Electromagnetic Compatibility”: The decision of the EEC Board dated 07/09/2024 No. 79 amends the lists of international and regional standards to ensure compliance with the requirements of the CU technical regulations.

* Changes in the lists of standards for the TR CU “On the safety of furniture products”: The decision of the Board of the EEC dated 07/09/2024 No. 80 clarifies the timing of the application of standards to ensure compliance with the requirements of the technical regulations of the Customs Union.

January 11th:

* Changes in classifiers for customs declarations: The decision of the Board of the EEC dated 10.12.2024 No. 139 introduces changes to the Classifiers used when filling out customs declarations (Appendix 2, 7, 8, 9, 23, 26).
