On January 6, 2025, changes regarding the grounds for unscheduled inspections by the State Labor Inspectorate (GIT) came into force. These changes were introduced by the order of the Ministry of Labor No. 640n dated 11/28/2024 and affect both large companies and individual entrepreneurs.
Major changes:
1. Cooperation with the self-employed
A check will be scheduled if:
• more than 35 self-employed are involved;
• their income from cooperation with one company exceeds 90%;
• the amount of payments exceeds 35,000 rubles per month;
• The cooperation lasts more than 3 months.
Penalties:
• For organizations: from 50,000 to 100,000 rubles.
• For sole proprietors: from 5,000 to 10,000 rubles.
2. Reduction of salaries in medical organizations
An unscheduled inspection is possible if the salary of 25% or more of the employees has been reduced.
Penalties:
• From 30,000 to 50,000 rubles (if the reduction is unjustified).
3. Payment of wages below the minimum wage
A check will be scheduled if:
• less than 60 employees receive salaries below the minimum wage during the quarter;
• such employees are at least half of the total number of employees.
Fines:
• For organizations: from 30,000 to 50,000 rubles.
• For sole proprietors: from 1,000 to 5,000 rubles.
4. Reduction of the wage fund
Grounds for verification:
• reduction of the fund by 80% or more without reducing the number of employees (15 people or more).
Penalties:
• According to part 6 of art.5.27 of the Administrative Code of the Russian Federation.
5. Increased accidents at work
Inspections will begin if the number of incidents has increased compared to last year:
• by 3 or more cases (up to 50 employees);
• for 4 or more cases (from 50 to 99 employees);
• for 5 or more cases (100 or more employees).
Penalties:
• Up to 200,000 rubles for organizations.
• Up to 40,000 rubles for sole proprietors.
Result
Most of the new indicators are not an automatic basis for verification. However, if they are accompanied by additional signs of violations, Rostrud initiates an unscheduled inspection. Employers should closely monitor changes in labor legislation to avoid fines and administrative sanctions.
